These Terms of Service ("Terms") govern access to and use of Cartógrafo, a SaaS web application for processing and publishing geographic data and creating interactive web maps.
Cartógrafo is provided by SOLUCOES SINTATICAS TECNOLOGIA LTDA, CNPJ 50.039.509/0001-16, located at Rua Professor Gabizo, 95, 301, Tijuca, Rio de Janeiro/RJ, Brazil. In these Terms, "Cartógrafo", "we", "us", or "our" refer to that entity. "You" means the person accessing or using Cartógrafo.
If you do not agree to these Terms, do not use Cartógrafo. For legal matters, support, payments, notices, or reports, contact us at [email protected].
Users located in the European Economic Area, Switzerland, or the United Kingdom may have additional rights as described in these Terms and under applicable law.
These Terms were adapted from terms made available by Automattic under a Creative Commons ShareAlike license. If you reuse these Terms, revise them so they reflect your own practices.
1. The service
Cartógrafo allows users to upload their own geographic data, process that data through nodes, visually edit maps, create interactive filters, widgets, popups, legends, and map pages. A map can be published at its own URL, shared publicly, and embedded in third-party websites through an iframe or embed.
Uploaded data is stored and processed in our cloud. Processing involves data in PostGIS and may include transformations, filters, combinations, simplifications, enrichment, and generation of new geographic data. Cartógrafo does not currently offer export of data, images, tiles, GeoJSON, shapefiles, PDFs, or other formats.
Cartógrafo is a SaaS web application. An API may be offered in the future. Integrations with Google Sheets, URLs, APIs, external PostGIS databases, and parquet files hosted by third parties may also be added in the future. Cartógrafo does not allow users to install plugins, custom integrations, or webhooks.
2. Preview product
Cartógrafo is in preview. During this phase, features may change, be removed, migrated, reset, or interrupted. We may also change plan limits and technical behavior of the service.
We do not currently provide any minimum commitment for availability, backup, SLA, or uptime. During development, user data may be deleted, lost, migrated, or reset for technical reasons. You should keep your own copies of data you upload to Cartógrafo.
Support response time is up to 2 business days through [email protected]. This is not an uptime guarantee and does not guarantee that every issue will be resolved within that period.
3. Account and security
To use Cartógrafo, you need to create an account. Registration may be done with email and password or with Google login. You must provide complete and accurate information and keep it updated so we can contact you about your account, payments, changes to the Terms, security issues, or legal communications.
Cartógrafo is currently for individual use. There are no organizations, teams, or collaborative workspaces. You are responsible for all activity under your account.
You must protect your credentials, not share passwords, and notify us immediately if you suspect unauthorized access or a security issue. If we believe your account has been compromised, we may suspend or disable it.
You must create the account as an individual person. Agencies and consultants may create maps for clients using Cartógrafo, but remain responsible for account use, uploaded data, published maps, and compliance with these Terms.
4. Minimum age
Cartógrafo is not directed to children. You may not use Cartógrafo if you are under 13 years old, or under 16 if you are in Europe. If you are under 18, or under the legal age of majority where you live, you may use Cartógrafo only under the supervision of a legal guardian who accepts these Terms.
5. User data
You may upload GeoJSON, shapefile, CSV, parquet, and geoparquet files to Cartógrafo. You retain ownership of the data you upload and the maps you create. By using Cartógrafo, you give us the permission needed to host, store, process, transform, generate tiles from, display, publish, share, and embed that data and those maps according to the features you use.
You are responsible for uploaded data, node configurations, created maps, public pages, descriptions, legends, links, and other content associated with your maps.
You may not use Cartógrafo to publish, disclose, process, or make available illegal data, sensitive personal data without a legal basis, confidential data, children's data, health information, public security data, discriminatory content, pornographic content, or any content that violates laws, third-party rights, or these Terms. You also may not publish maps that expose personal data, sensitive data, or sensitive geographic content.
We may use aggregated or anonymized data to improve the product, statistics, performance, and research. If we want to display public maps created by users in galleries, showcases, or marketing materials, we will contact you first.
You may delete your data. Deletion removes the data from your account and the corresponding publication. During preview, we do not back up user data. If backups are implemented in the future, backup copies may retain deleted data for up to 3 months before those copies are permanently removed.
There is currently no specific retention policy for inactive accounts.
6. Public maps, embeds, and moderation
You may publish analyses and maps at public URLs. Public maps can be accessed by anyone with the link and may be embedded in third-party websites through an iframe or embed. The published page may include a map, visualized data, text, descriptions, links, and legends.
We do not pre-moderate all public content. Even so, we may remove maps, data, public pages, or accounts that violate laws, third-party rights, or these Terms. Abusive or illegal content, or content that violates copyright, may be reported at [email protected].
Links to third-party websites do not mean that we endorse those websites. We do not control third-party websites and are not responsible for their content, availability, policies, or practices.
7. Geographic processing and responsibility for results
Cartógrafo nodes are an abstraction for operations on geographic data. The system may return empty or unexpected results when the operation configured by the user does not make sense for the data used, for example filtering data that does not exist or applying a geometric operation to non-geometric data.
You are responsible for reviewing the logic of your analysis, the suitability of the data, node configurations, and interpretation of results. Cartógrafo is not responsible for decisions made based on maps, analyses, or results generated in the service, including emergency, health, safety, navigation, construction, legal, public policy, or other critical uses.
Cartógrafo does not currently integrate official or third-party sources as internal data sources of the system.
8. Payments, plans, and invoices
Paid Cartógrafo plans are annual. There is currently no free trial. The subscription does not renew automatically: each year requires a new invoice or manual renewal.
Payment may be made by invoice, boleto, bank transfer, PIX, or card, according to the methods made available. In Brazil, SOLUCOES SINTATICAS TECNOLOGIA LTDA issues invoices, boletos, and applicable charges. Internationally, we may use Wise.com.
The invoice payment period is 7 days. Access starts after payment. If the invoice is not paid on time, there may be a grace period, and you may contact us to try to resolve the pending payment. Non-payment may lead to suspension or termination of access.
Prices may be set in BRL for Brazilian users and USD for international users. We may change prices with notice.
The paid plan includes up to 50 GB of total storage among uploaded data, operations, and generated tiles. There is no limit on maps or nodes. There is also no fixed limit on processing or requests, as long as the use does not harm other users' experience or the operation of the service. If an operation harms other users or the infrastructure, we may limit, postpone, or refuse to run it.
If you no longer want to use Cartógrafo, send an email to [email protected]. We will refund the remaining time in the subscription. We may ask the reason for cancellation, but the proportional refund will be made.
European users: if applicable law gives you a right of withdrawal within 14 days, you may exercise it by sending a clear written request to [email protected]. When required by law, we will refund amounts paid using the same payment method used in the original transaction, unless otherwise agreed. Services already provided may be considered proportionally when allowed by law.
9. Acceptable use
You agree that your use of Cartógrafo:
- will comply with these Terms and applicable law, including privacy, data protection, copyright, intellectual property, consumer protection, competition, and advertising laws;
- will not have an illegal purpose and will not publish illegal content;
- will not violate our intellectual property rights or third-party rights;
- will not disclose personal data, sensitive data, children's data, confidential data, or data you do not have the right to use;
- will not be used for surveillance, individual tracking, discrimination, sensitive targeting, or illegal activities;
- will not be used for pornography or sexual content involving children;
- will not send spam, unsolicited bulk messages, or abusive traffic;
- will not perform scraping, excessive mining, API abuse, abusive automation, or use that overloads the system;
- will not attempt to access other users' data, exploit vulnerabilities, bypass plan limits, compromise security, or interfere with networks and services;
- will not create, distribute, or enable malware, spyware, adware, or malicious code;
- will not reverse engineer, decompile, disassemble, or attempt to obtain the source code of Cartógrafo or related technologies that are not open source.
You may provide services to clients using Cartógrafo and may share or commercialize the maps and results you create, provided that you comply with these Terms, do not improperly share credentials, and remain responsible for the data, content, and uses performed through your account.
10. Intellectual property and feedback
Cartógrafo software is closed source. These Terms do not transfer to you any rights in Cartógrafo software, brand, name, logo, visual identity, code, design, documentation, or other assets.
You may use the Cartógrafo name and logo to state that you use the platform, as long as this does not suggest partnership, sponsorship, endorsement, or official representation without authorization.
If you send comments, ideas, suggestions, or feedback, we may use them without restriction and without compensation.
11. Third-party services and infrastructure
Cartógrafo uses third-party services to operate parts of the service. These services include Hetzner for server and database, Cloudflare for static file hosting and processed datasets, Firebase for login, OpenFreeMap for base maps, and Wise.com for international payments when applicable.
Datasets uploaded by users may be processed, transformed into parquet, and hosted on Cloudflare. Use of third-party services may be subject to the terms and policies of those third parties. We do not control those services and are not responsible for their failures, downtime, changes, or practices except as required by law.
Cartógrafo uses cookies, analytics, or tracking mechanisms in the product.
12. Privacy, LGPD, GDPR, and DPA
Cartógrafo is provided by a Brazilian company, but may be used worldwide. You must comply with LGPD, GDPR, and other data protection laws that apply to your use of Cartógrafo.
Cartógrafo's legal role regarding the data you place in the platform may depend on the specific case and contract. If you need a data processing agreement, DPA, or similar contract for GDPR, LGPD, or enterprise customer requirements, contact us at [email protected].
13. Changes to the service and Terms
We may change features, remove functionality, change plan limits, and modify these Terms. Changes to the Terms take effect when published, unless we state another date. When a change is material, we may notify you by email.
If you continue using Cartógrafo after updated Terms are published, we will treat that as acceptance of the new version. If you do not agree, stop using Cartógrafo and, if you have a paid plan, request cancellation.
14. Suspension, termination, and data deletion
We may suspend or terminate your account for non-payment, technical abuse, illegal use, rights violations, security risk, inactivity, violation of these Terms, or use that harms other users or infrastructure. When possible, we will try to notify you before suspension.
You may stop using Cartógrafo at any time. If you have a paid plan, you may cancel according to the payments and refunds section.
After account termination, data may remain available for up to 1 week for export, when export is available or when there is an applicable technical method. After that, we may delete data related to the account. We may also delete data after cancellation, non-payment, or inactivity.
During preview, we may reset, migrate, or delete data for technical reasons.
15. Disclaimers
Cartógrafo is provided "as is" and "as available". To the extent permitted by law, we do not guarantee that the service will be continuous, error-free, secure, suitable for a specific purpose, or free from data loss.
You use Cartógrafo at your own risk. You are responsible for keeping copies of uploaded data and reviewing generated results.
16. Limitation of liability
To the extent permitted by law, we, our suppliers, partners, and licensors will not be liable for indirect, incidental, special, consequential damages, lost profits, interruption of use, loss of data, data corruption, cost of substitute services, or damages resulting from decisions made based on maps, analyses, or data generated in Cartógrafo.
To the extent permitted by law, our total liability for any claim related to Cartógrafo will be limited to the amount paid by you to Cartógrafo in the 12 months before the event giving rise to the claim. This limitation does not apply where the law does not allow limitation, or where applicable law imposes liability that cannot be excluded.
European users: if you are a consumer in Europe, nothing in these Terms limits mandatory rights that cannot be limited under the law of your country of residence, including liability for death or personal injury caused by negligence, willful misconduct, gross negligence, or other cases where limitation is prohibited.
17. Indemnification
You agree to indemnify and hold harmless Cartógrafo, its contractors, suppliers, licensors, directors, employees, and agents from losses, liabilities, demands, damages, costs, claims, and expenses, including attorneys' fees, arising from your use of Cartógrafo, violation of these Terms, violation of laws or third-party rights, data you upload, or maps and content you publish.
18. Applicable law
These Terms are governed by the laws of Brazil, with reference to Rio de Janeiro/RJ where applicable. Nothing in these Terms affects mandatory rights of foreign consumers that cannot be waived under the law of the user's country of residence.
19. Language and translation
These Terms may exist in Portuguese and English. In case of conflict between versions, the Portuguese version controls.
20. General
These Terms, together with other specific terms we may publish for certain services or plans, constitute the entire agreement between you and Cartógrafo regarding use of the service.
If any part of these Terms is considered invalid, illegal, or unenforceable, that part will be separated from the Terms, and the rest will remain valid. Failure to exercise any right under these Terms does not waive that right.
We may assign our rights and obligations related to Cartógrafo without condition. You may assign your rights or obligations only with our prior written consent.
